Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Merchant", "you", "your") and CrawlWithAI (Mumbai, Maharashtra, India) ("Company", "we", "us", "our") governing your access to and use of the CrawlWithAI application, website, and related services (collectively, "Services").

By installing the CrawlWithAI Shopify app, clicking "I Agree", accessing the Website, or otherwise using the Services, you represent that: (a) you have read, understood, and agree to be bound by these Terms; (b) you are authorised to enter into this agreement on behalf of yourself or the organisation you represent; (c) you are at least 18 years of age; and (d) your use of the Services complies with all applicable laws and regulations.

If you do not agree to these Terms, you must not install, access, or use the Services.

CrawlWithAI provides the following services to Shopify Merchants:

• AI Traffic Attribution: Identifying and attributing website sessions and purchases that originate from AI platforms (ChatGPT, Gemini, Claude, Perplexity, Grok, Meta AI, Copilot, and others).
• AI Sitemapping: Detecting and logging AI crawler bot visits to the Merchant's Shopify storefront, including crawl frequency, pages indexed, and activity timelines.
• Revenue Intelligence Dashboard: A real-time dashboard displaying AI-attributed revenue, confidence scores, customer journey reconstructions, and traffic source breakdowns.
• Customer Journey Reconstruction: Mapping the sequence of touchpoints leading to a purchase, surfacing AI discovery as part of the purchase journey.
• Confidence Scoring: A proprietary algorithm assigning reliability scores to each attributed order.

We reserve the right to modify, update, or discontinue any feature of the Services with reasonable notice. Material changes will be communicated per Section 18.

• Access to the Services requires a valid Shopify store and installation of the CrawlWithAI app from the Shopify App Store.
• You are responsible for maintaining the confidentiality of your Shopify account credentials and for all activities that occur under your account.
• You must promptly notify us at support@crawlwithai.com of any unauthorised access or security breach.
• We reserve the right to suspend or terminate accounts that show signs of abuse, fraud, or violation of these Terms.
• One Shopify store corresponds to one account. Installing the App on multiple stores requires separate subscriptions.

CrawlWithAI offers a 4-day free trial ("Trial Period") upon first installation. During the Trial Period:

• You have full access to all features included in your selected subscription plan.
• No payment method is required to begin the trial through Shopify Billing.
• If you do not cancel before the Trial Period ends, your subscription will automatically begin and your payment method will be charged on the first day following the trial.
• The Trial Period is available once per Shopify store. Re-installations after a prior trial do not qualify for an additional trial.
• We reserve the right to modify trial terms with notice.

5.1 Plans and Pricing

CrawlWithAI offers subscription plans billed on a monthly or annual basis. Current pricing is displayed on the Website and within the Shopify App Store listing. Prices are in USD unless stated otherwise.

5.2 Billing

All billing is processed through Shopify's billing system. By subscribing, you authorise Shopify to charge your payment method on a recurring basis. We do not store or directly process payment card information.

5.3 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at your next billing cycle. Continued use of the Services after a price change constitutes acceptance of the new pricing.

5.4 Taxes

Prices are exclusive of applicable taxes including GST (India: 18% GST applicable on B2B and B2C transactions), VAT, or sales tax. You are responsible for paying all applicable taxes in your jurisdiction.

5.5 Failed Payments

If a payment fails, Shopify may retry the charge. Persistent payment failure may result in service suspension. Access is restored upon successful payment.

Cancellation and refund terms are governed by our Refund & Cancellation Policy available at crawlwithai.com/refund. Key terms:

• You may cancel your subscription at any time by uninstalling the App from your Shopify admin.
• Cancellation takes effect at the end of the current billing period. You retain access to Services until then.
• Subscriptions are non-refundable after the first charge except in limited circumstances set out in the Refund Policy.
• The 4-day free trial is provided at no charge; no refund is applicable for the trial period.

You agree not to use the Services to:

• Violate any applicable local, national, or international law or regulation.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App or Services.
• Access or attempt to access data belonging to other Merchants or End Users.
• Introduce malicious code, viruses, or disruptive elements into the Services.
• Use the Services to build a competing product or service.
• Misrepresent your identity or affiliation with any person or entity.
• Resell, sublicense, or transfer access to the Services without our written consent.
• Overload, stress-test, or conduct denial-of-service attacks against our infrastructure.
• Scrape, crawl, or extract data from the Services by automated means beyond normal API usage.
• Use the Services for any unlawful, fraudulent, or harmful purpose.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

8.1 Our Intellectual Property

All intellectual property rights in the Services, including but not limited to the App, Website, algorithms, software, design, branding, trademarks, and documentation, are owned by or licensed to CrawlWithAI. Nothing in these Terms transfers ownership of any intellectual property to you.

8.2 Your Data

You retain all rights to your Shopify store data. By using the Services, you grant us a limited, non-exclusive, non-transferable licence to access and process your store data solely to provide the Services as described in these Terms and our Privacy Policy.

8.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Services may be used by us without restriction or compensation to you.

Each party may have access to confidential information of the other. Both parties agree to: (a) maintain confidentiality of such information; (b) use it only for purposes of the agreement; (c) not disclose it to third parties without prior written consent; and (d) apply the same degree of protection as applied to their own confidential information (at least reasonable care). This obligation survives termination for 3 years.

Confidentiality obligations do not apply to information that is: (a) publicly available; (b) independently developed; (c) received from a third party without restriction; or (d) required to be disclosed by law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

• We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
• Attribution data and confidence scores are based on available signals and probabilistic algorithms; we do not guarantee 100% accuracy of attribution.
• We are not responsible for AI platform behaviour, changes to AI bot user-agents, or modifications to AI platform crawling policies that may affect data accuracy.
• We do not warrant any particular business outcome, revenue increase, or improvement in AI rankings resulting from use of the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRAWLWITHAI, ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL.
• COST OF PROCUREMENT OF SUBSTITUTE SERVICES.
• ANY DAMAGES RESULTING FROM INACCURATE ATTRIBUTION DATA OR RELIANCE ON DASHBOARD METRICS.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO CRAWLWITHAI IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) USD $100.

Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in such cases, our liability is limited to the minimum extent permitted by law.

You agree to indemnify, defend, and hold harmless CrawlWithAI and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:

• Your use of the Services in violation of these Terms.
• Your violation of any applicable law or the rights of a third party.
• Your store's processing of End User data and any claims brought by End Users against you.
• Any misrepresentation made by you in connection with the Services.

13.1 Termination by You

You may terminate your subscription at any time by uninstalling the App from your Shopify admin. Termination does not entitle you to a refund for any unused portion of your subscription.

13.2 Termination by Us

We may suspend or terminate your access to the Services immediately and without notice if you: (a) violate these Terms; (b) engage in fraud or illegal activity; (c) fail to pay subscription fees; or (d) use the Services in a way that poses a risk to us or other users.

13.3 Effect of Termination

Upon termination: (a) your right to access the Services ceases immediately; (b) we will delete your data per our data retention policy (Section 9 of the Privacy Policy); (c) provisions that by their nature should survive (including Sections 8, 10, 11, 12, 14, 15, 16) will continue in force.

These Terms are governed by and construed in accordance with the laws of India, specifically the laws of the State of Maharashtra, without regard to conflict of law principles. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising from or related to these Terms or the Services.

If you are a consumer in the EU or UK, mandatory consumer protection provisions of your local law may also apply, and you may have the right to bring claims before courts in your country of residence.

15.1 Informal Resolution

Before initiating any formal proceedings, parties agree to attempt to resolve disputes informally. Contact us at support@crawlwithai.com with a description of the dispute. We will attempt to resolve the matter within 30 days.

15.2 Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with a single arbitrator appointed by mutual agreement. Arbitration shall be conducted in Mumbai, Maharashtra in the English language.

15.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

The Services integrate with Shopify and may reference or interact with AI platforms and their public APIs. We are not affiliated with, endorsed by, or responsible for Shopify, OpenAI, Google, Anthropic, Perplexity, xAI, Meta, or Microsoft. Your use of those platforms is governed by their respective terms of service. Changes by those platforms to their APIs, bot policies, or crawling behaviour are outside our control and may affect Service accuracy.

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including: acts of God, natural disasters, pandemics, government actions, internet outages, third-party service failures (including Shopify infrastructure), cyberattacks, or labour disputes. We will notify you promptly and resume performance as soon as reasonably practicable.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to your registered address and/or notice within the App dashboard at least 14 days before they take effect. For non-material changes, the updated Terms will be posted on the Website with the revised effective date. Continued use after the effective date constitutes acceptance.

• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and CrawlWithAI regarding the Services.
• Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary, and remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
• Assignment: You may not assign your rights or obligations without our prior written consent. We may assign our rights in connection with a merger or acquisition.
• No Partnership: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
• Notices: Legal notices to us must be sent to support@crawlwithai.com. We may send notices to you at the email associated with your Shopify account.
• Language: These Terms are written in English. In case of conflict between translated versions, the English version prevails.
